Use of our website includes accessing, browsing, purchasing or registering to use our website.

Your continued use of this website following any change in the Terms and Conditions will be deemed to constitute acceptance by you to those changes.

a)We may update our website from time to time and may change the content at any time. However, please note that any of the content on our website may be out of date at any given time, and we are under no obligation to update it.

b)We do not guarantee that our website, or any content on it, will be free from errors or omissions.

6.Accessing our website and continuity of service

a)Our website is made available free of charge. Visitors can view our website for free. Registered users and paying members of Business West Chambers of Commerce (including Bristol, Bath, Gloucestershire and Wiltshire) and Initiative members (West of England and Swindon & Wilts) will be granted access to the website registered users and paying members areas which gives them access to additional benefits and services as part of their registered status or Chamber or Initiative membership. 

b)We will use our reasonable endeavours to provide you with a prompt and continuing service. We do not however warrant that the service we provide will continue uninterrupted or without delay or that it will remain unchanged. In particular, we reserve the right to bring the website down as and when we consider the same to be necessary or desirable for the purposes of maintenance. 

c)Indemnity in using the website: you indemnify us against any actions, claims, demands or other proceedings brought by any third party against us as a consequence of your use of the website or app. 

d)Quality of service: Whilst we will use reasonable endeavours to ensure that the information contained in the website or app is correct and reliable, no warranty, either express or implied, is given as to the accuracy or completeness of that information.

e)Access to our website is permitted on a temporary basis. We may suspend, withdraw, discontinue or change all or any part of our website without notice. We will not be liable to you if for any reason our website is unavailable at any time or for any period.

b)Acceptance by you of any services provided by a TSP may form a contract between you and the TSP directly. It is your responsibility to check whether acceptance of such services will be construed as confirming your total and unequivocal acceptance of the terms and conditions of service.

12.Uploading content to our website

a)Whenever you make use of a feature that allows you to upload content to our website, or to make contact with other users of our website, your use of our website must be only for lawful purposes and not in a manner that would damage our reputation in any way or be considered inappropriate, offensive or inflammatory.

b)You warrant that any such contribution or use of our website does comply with the above standards, and you will be liable to us and indemnify us for any breach of that warranty. If you are a consumer user, this means you will be responsible for any loss or damage we suffer as a result of your breach of warranty.

14.Use of online directory

The Business West online directory is not a "free to advertise to” database - the sending of unsolicited emails (SPAM) advertising products and services to members using forums or directly to members 

e-mail addresses is NOT PERMITTED. The collection of Business West members e-mail addresses from the profile pages or from the database for any use without the written permission of Business West is considered as theft. Legal action will be taken against offenders. 

Business West is not liable for any misrepresentation of a member and does not guarantee the reliability of any of its members, their products or services. 

Business West will not intervene in disputes between members and do not accept any liability to any party whatsoever for any disputes arising due to postings on the website, messages, emails, telephone call or meetings by a particular member(s). Members enter into a trading relationship at their own risk and take full responsibility to undertake their own due diligence prior to engagement of any sort.

Business West will not comment on individual cases of a breach of these terms and conditions.

15.Viruses

a)We do not guarantee that our website will be secure or free from bugs or viruses.

b)You are responsible for configuring your information technology, computer programmes and platform in order to access our website. You should use your own virus protection software.

c)You must not misuse our website by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our website, the server on which our website is stored or any server, computer or database connected to our website. You must not attack our website via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our website will cease immediately.
